Abstract

[32.05] This chapter outlines the fundamental principles and emerging issues of industrial and employment law (workplace law), that is: a. the law regulating the formation and operation of the employment contract; b. the laws governing the workplace and relationships and standards in the workplace) eg minimum conditions of employment, enterprise bargaining conditions, discrimination and unfair dismissal; c. the principles applying to the operation of trade unions and the associated issues of strikes and enterprise bargains; d. the role of bodies such as the Australian Fair Pay Commission and the Australian Industrial Relations Commission; and e. constitutional issues regarding the sources of industrial legislation.
