Abstract

The situation involving Australian swimmer, Nicholas D'Arcy, and the Australian Olympic Committee (AOC) over whether he should be removed from the Australian Olympic team for the 2008 Beijing Olympic Games, has received much media attention. After the AOC made the decision to drop D'Arcy from the team, it was then subject to an appeal to the Court of Arbitration for Sport (CAS). This case note will therefore examine the decision in D'Arcy v Australian Olympic Committee in regard to this particular issue, and also look at the similar situation that then arose with mountain bike rider, Chris Jongewaard.
