Abstract

The Essendon doping saga has seen internal investigations and tribunal hearings, Federal Court cases, a CAS hearing, and an appeal to the Swiss courts. It therefore highlights all the potential avenues that can be used by governing bodies, anti-doping authorities, and players, in regard to doping offences. It is suggested the Federal Court cases have provided useful judicial interpretation of the relevant statute while the CAS decision has provided insight into how that arbitration body approaches the use of hearsay and circumstantial evidence.
