Innovation is a shared pursuit of academia and industry. Despite this, there exists a structural tension that is often accused of inhibiting dialogue between these two groups. Industry innovation is market driven, whereas academia operates, to a certain extent, external to the market. As a consequence, academia faces allegations by industry of lacking efficiency, direction, and general practicality. This paper analyses the relationship of academia and industry in the so-called information age within the context of copyright law. It is argued that the underlying structural differences of academia and industry provides for a dialogue not possible in a unitary system. The tensions that exist between academia and industry may therefore be supportive of the interests of society.
