Abstract
[Extract]The native title process is for the most part driven by courts, court related processes and the legal culture: Indeed, native title is itself a product of the court, a creature of the common law that has become an expression of the Native Title Act 1993 (Cth)('NTA').
In this sense the notion of native title is very alien to most parties involved in the native title process, including Indigenous peoples. Ironically, the NTA has also provided a space for the interaction of parties outside of the court.
