Abstract

[Extract] Human rights violations of children in state and territory juvenile justice systems have received widespread attention in Australia over recent years. In July 2016, then Prime Minister Malcolm Turnbull announced a Royal Commission into the Northern Territory (‘NT’) Child Protection and Youth Detention Systems. The announcement came following the publication of CCTV footage and images documenting routine abuse of children detained in youth detention centres in the NT. Within weeks of this announcement, the Queensland Government announced an independent review of its youth detention centres following allegations of the use of excessive force against detainees. In the following months Tasmanian, New South Wales (‘NSW’), Victorian and the Australian Capital Territory (ACT) all announced inquiries into similar problems at their detention facilities. Indeed, the Australian Child Rights Taskforce identified more than 14 state and territory reviews and inquiries between 2015 and 2018, which drew attention to ‘widespread and systematic failings’ in youth detention. The media has also highlighted the mistreatment of children in detention. For example, in 2019, the Australian Broadcasting Commission’s (ABC) Four Corners program showed the extensive problem of children being detained for extensive periods of time in police cells in Queensland (‘QLD’).
