Abstract

The Regulation of disputes involving community title in Queensland is covered by the Body Corporate and Community Management Act 1997 (Qld) and the recent case of Ainsworth v Albrecht involved the applicaton of that Act in regard to rights relating to common property. The dispute in question was originally referred to an adjudicator before being being appealed to QCAT, then the Queesland Supreme Court, and finally the High Court. Thus, the case provides an insight as to how disputes are to be resolved under the Act.
