Abstract

The loyalty and commitment agreements drawn up by the ARL in an attempt to stave off the threat of Super League, and the 14 team term incorporated into documents that accompanied the later merger, were held by the Full Federal Court to be exclusionary provisions under s 45 of the Trade Practices Act 1974 (Cth). There is an argument, however, that authorisation under s 88 of the Act could have been sought, and this raises the broader question as to whether sporting organisations should be given, if not a blanket exemption to restrictive trade practices legislation, then at least exemptions on a case by case basis.
